The sentencing for Jason David Sadowski has been delayed even further after a hearing was delayed on Wednesday.
Proceedings on December 7 regarded an unruled motion from the trial in October. After the prosecution rested its case, Sadowski’s defense attorney Mark Dobias argued that there was not enough evidence to prove the charge. While 11th Circuit Judge Brian Rahilly ruled that there was enough evidence for the charges of second-degree murder and voluntary manslaughter, denying Dobias’s motion. However, Rahilly did not make a ruling on the motion regarding first-degree murder.
The jury convicted Sadowski of murder in the first degree, creating the problem.
After the trial ended, Sadowski was taken into custody of the Michigan Department of Corrections and transferred downstate to a prison in Jackson. He attended the hearing through Zoom, along with Dobias. Cocounsel Tony Ruiz was in person for the hearing.
Rahilly said that given the nature of the motion, Sadowski should be in person for the hearing.
“After discussions in chambers, we’re going to adjourn today’s proceedings as it’s probably better to have (Sadowski) here in person,” the judge said.
Sadowski alleged during the hearing that there have been “prisoner intake” issues with the MDOC and said that he was not aware of the situation because he was having difficulties setting up the necessary accounts to communicate with his attorneys. Ruiz did not speculate the cause, but confirmed that there were communication issues.
The hearing to address the motion of whether or not the prosecution provided enough information to warrant a first-degree murder will be held at the Alger County Courthouse on Monday, Dec. 12 at 3:30 p.m.. A writ was ordered through the Alger County Prosecutor’s Office to transport Sadowski while also giving the victim’s family an opportunity to come to the proceedings as well.
Pending the Monday proceedings, sentencing is expected to be at the next Circuit Court motion day on Wednesday, Dec. 12.
