Defendant’s outbursts impact 11th Circuit motion day

William John Quarfoot expressed great displeasure with his attorney, the proceedings and any potential plea offers at 11th Circuit Court motion day on Tuesday, May 16 in the Alger County Courthouse.

Facing one count of assault with a weapon, Quarfoot repeatedly yelled over his attorney, accused her of making deals against his best interest with the prosecution and claimed that the court lied about bond procedures so he would not receive his money back. Quarfoot said that he had transcripts stating that 11th Circuit Court Judge Brian Rahilly required the court to handle the bond properly, but court staff clarified that the type of bond posted would not result in the type of refund Quarfoot was demanding.

Quarfoot’s attorney Jen French of Sault Ste. Marie wanted to make it clear during the hearing that if Quarfoot were to continue his outbursts, that it could not result in a mistrial. The defendant then screamed again, requiring bailiffs to stand on multiple sides of Quarfoot for the rest of the hearing. The case is expected to go to trial in June.

In other cases, Shaun SaintAmour waived his circuit court arraignment. Originally on the docket for Tuesday, his attorney Derek Swajanen of Marquette filed to waive the arraignment for one count of a controlled substance less than 25 grams and a charge related to alcohol licensing and advanced to the first pretrial conference.

Andrew DeVries pled guilty to one count of entering without breaking and one count of assault and battery. The charges stem from an incident on January 23 where DeVries entered a building and committed an assault on a non-related male adult. The initial charges included one count of breaking and entering and one count of domestic violence, but both were dropped as part of a plea deal that was submitted in accordance with the Crime Victims Rights Act.
